TERMS AND CONDITIONS
DAYLS INTERNATIONAL ACADEMY FOR PERFORMING ARTS L.L.C.
1. Introduction
These terms and conditions govern your use of the courses and services offered by DAYLS INTERNATIONAL ACADEMY FOR PERFORMING ARTS L.L.C. through our website, mobile application, and other platforms. By accessing or using our courses and services, you agree to comply with these terms and conditions in full. If you do not agree to these terms, you must refrain from using our services.
2. Course Enrolment
2.1. To enrol in our courses, you must provide accurate, complete, and up-to-date information as requested during the registration process.
2.2. We reserve the right to refuse, suspend, or cancel enrolment at our sole discretion, including but not limited to cases of suspected fraud, misrepresentation, violation of these terms, or disruptive conduct.
3. Course Content
3.1. We strive to ensure the accuracy and relevancy of all course materials. However, DAYLS INTERNATIONAL ACADEMY FOR PERFORMING ARTS L.L.C. makes no warranties or guarantees regarding the completeness, reliability, or suitability of the course content for any specific purpose.
3.2. Course content, including lesson plans, recordings, exercises, and original compositions, is protected by intellectual property laws and may not be reproduced, distributed, modified, published, or used for derivative works without express written permission from the Academy.
4. Payment
4.1. Monthly Fee Amount
Each student’s monthly fee is fixed based on the selected class type and package. This fee remains constant for the billing cycle unless amended by the Academy with prior notice.
4.2. Payment Deadline and Late Fees
Payments must be made in full within the first calendar week of every month. For instance, July’s fee must be paid by the end of the first week of July. Payments received after this period will incur a late fee of AED 50, which will be added to the student’s outstanding balance.
4.3. Five-Class Month Policy
In instances where a given day of the week occurs five times in a calendar month (e.g., five Mondays), no additional fees will be charged. The fifth session will be treated as a bonus or make-up class, or allocated for jam sessions or group performances based on class level.
4.4. Class Pack Expiry
Prepaid Class Packs are subject to expiry. Any unused sessions within a pack that have not been scheduled before the expiry date are forfeited and non-recoverable. No rescheduling is permitted beyond the pack’s validity period.
4.5. Price Adjustments
Fees are subject to change at the discretion of the Academy. Notice will be provided in advance for any changes to fee structures or billing cycles.
5. Refund and Cancellation Policy
5.1. Cancellation by Client
Class cancellations initiated by students or parents are subject to approval by the Academy. If approved, the student may be entitled to reschedule the missed class within the guidelines outlined in Clause 5.4.
5.2. Late Cancellations
Reschedule requests submitted less than 24 hours before a scheduled class, without valid emergency reasons (e.g., medical or unforeseen personal circumstances), will be considered forfeited.
5.3. Exceptional Circumstances
Rescheduling due to emergencies (e.g., hospitalisation, documented illness) may be granted at the Academy’s sole discretion, based on the submission of appropriate supporting documentation.
5.4. Request Procedure
All rescheduling requests must be submitted at least 24 hours in advance of the class start time and must be communicated through the Dayls Academy mobile app or via direct phone call to Academy administration. Only admin-approved reschedules will be honoured.
5.5. Travel-Based Rescheduling
If a student is unable to attend classes due to travel, parents are required to notify the Academy in advance. Upon return, missed classes will be rescheduled accordingly. Failure to inform the Academy prior to the travel period may result in forfeiture of those sessions.
5.6. Cancellation by the Academy
We reserve the right to cancel or reschedule classes at our discretion due to teacher unavailability, force majeure, or other operational circumstances. In such events, students will be eligible for a rescheduled session or a full refund for that class, depending on the situation.
6. Intellectual Property
6.1. All course content, including but not limited to text, audio, video, sheet music, and visuals, is the intellectual property of DAYLS INTERNATIONAL ACADEMY FOR PERFORMING ARTS L.L.C. or its licensors.
6.2. Students may not share, distribute, or use the materials provided during the course for commercial use or any public dissemination without prior written authorisation from the Academy.
7. Limitation of Liability
7.1. To the maximum extent permitted by applicable law, the Academy shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in our courses or use of our services.
7.2. The Academy’s total liability for any claims arising from these terms shall not exceed the total fees paid by the student for the specific course or service in question.
8. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of Dubai, United Arab Emirates. Any disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Dubai, UAE.
9. Amendments
DAYLS INTERNATIONAL ACADEMY FOR PERFORMING ARTS L.L.C. reserves the right to amend, modify, or update these terms at any time without prior notice. Continued use of our services after changes have been posted constitutes acceptance of those changes.
